The rules for using TREADIVO, placing orders, paying, booking fitting, and working with our Authorised Service Partner network.

1.Introduction

Tyreo Pty Ltd trading as TREADIVO (ABN 64 700 631 849) (we, us, our or TREADIVO) owns and operates the TREADIVO website, mobile application and related services. These Terms and Conditions (Terms) apply to every person who accesses, browses or uses TREADIVO, including customers who purchase tyres, fitting or related services, and businesses approved as Authorised Service Partners. By using TREADIVO you accept these Terms. If you do not agree, you must not use TREADIVO. Read these Terms together with our Privacy Policy, Refund, Returns, Cancellation & Rescheduling Policy and, where applicable, the Authorised Service Partner Terms.

2.Definitions

Customer means a person or entity that places an order through TREADIVO.

Authorised Service Partner or Partner means an independent tyre fitting, wheel alignment or automotive business approved by TREADIVO to perform services for customer orders. Order means a request by a Customer to purchase goods and/or services through TREADIVO, including tyres, fitting, balancing, wheel alignment, valves, disposal and related items. Goods means tyres, wheels and any physical products supplied as part of an Order.

Services means fitting, balancing, alignment and any labour services supplied as part of an Order. Supplier means a third-party tyre or automotive wholesaler, distributor or manufacturer whose stock, pricing or fulfilment TREADIVO may use.

3.Using TREADIVO

You may use TREADIVO to search, compare and order tyres and related services. You must provide accurate and complete information, including vehicle details, contact information, delivery or fitting location and payment details. You must not use TREADIVO for fraudulent, unlawful, misleading or abusive purposes. We may suspend or terminate access where we reasonably believe a breach has occurred. TREADIVO lists tyre and service information, including prices, specifications, ratings, quality tags and competitor comparisons, based on data from suppliers, manufacturers and public sources. We take reasonable steps to keep the catalogue accurate, but minor variations in description, image, availability and price may occur.

4.Quotes, pricing and payment

All prices displayed on TREADIVO are in Australian dollars (AUD) and include GST unless clearly stated otherwise. Prices include the tyre or service item shown, our standard fitting, balancing, valve and disposal fees where selected, and any applicable state-based charges such as specialty tyre fitting fees. The price payable is the price shown at the time you complete checkout and make payment. We accept payment via Stripe, including credit and debit cards, Apple Pay, Google Pay, Zip and Afterpay. Stripe terms and your card issuer terms also apply. We may offer promotional codes, bundle deals and partner-specific pricing. Promotions must be applied at checkout, cannot be combined unless stated, and may be subject to product, quantity, location or time limits. For manual, external or phone orders, TREADIVO may issue an invoice or Stripe payment link. Payment must be received before the Order is confirmed unless TREADIVO expressly agrees otherwise in writing.

5.Orders, confirmation and supply

An Order is an offer by the Customer to purchase. TREADIVO acceptance occurs when we send an order confirmation or otherwise confirm the Order. Until then, we may decline or cancel an Order for reasons including unavailability, pricing error, inability to deliver to the location, or suspected fraud. TREADIVO is the seller and merchant of record for customer orders. We arrange supply from our supplier network and allocate an Authorised Service Partner to perform Services where selected. If a selected item becomes unavailable after acceptance, we will contact you to offer a replacement, reschedule or refund. You are not obliged to accept a substitute, but where a replacement is equivalent or better and you agree, our usual refund and remedy rights continue to apply. Tyre quantities are capped by live supplier stock. The website will not allow you to order more than the available stock shown. If stock reduces between ordering and fulfilment, we will contact you to resolve the shortfall.

6.Delivery, fitting appointments and risk

TREADIVO may deliver Goods to an Authorised Service Partner, to a Customer address, or make them available for pickup, depending on the Order selections. Title and risk in Goods pass to the Customer in accordance with applicable law and the delivery arrangement chosen. For goods sent to a fitter, risk generally passes on completion of fitting or on Customer pickup, whichever is agreed. Fitting appointments are scheduled through TREADIVO based on fitter availability and Customer preference. The Customer must arrive at the appointment with the vehicle in a suitable and safe condition. If the vehicle is unsafe, the fitter may refuse work and TREADIVO will discuss a remedy. If the Customer misses an appointment without a confirmed reschedule, TREADIVO may keep the order open, reschedule, cancel or refund after considering supplier and fitter costs. 7.Consumer guarantees and liability

TREADIVO supplies Goods and Services in Australia and the Australian Consumer Law (ACL) applies. Our Goods and Services come with consumer guarantees that cannot be excluded, including acceptable quality, fitness for purpose, matching description, and due care and skill. Nothing in these Terms limits or excludes any ACL right that cannot lawfully be limited or excluded. To the maximum extent permitted by law, TREADIVO's liability for non-ACL losses is limited to the price paid for the relevant Order or, where a single Order contains multiple items, the price of the specific item or service giving rise to the liability. We are not liable for loss that was not reasonably foreseeable or caused by the Customer, a third party or events outside our reasonable control.

8.Supplier and fitter arrangements

Authorised Service Partners are independent businesses. TREADIVO coordinates work orders and payments, but service partners are not employees, agents or partners of TREADIVO except as expressly stated. Service Partners must comply with the Authorised Service Partner Terms, applicable law and TREADIVO operating procedures. Customers must not pay an Authorised Service Partner directly for any part of a TREADIVO Order unless TREADIVO has first approved a genuinely separate transaction in writing. Direct payments made without approval are at the Customer's risk and may not be credited to the Order.

9.Warranties, returns and refunds

Tyre manufacturer warranties are additional to ACL rights and do not replace them. Warranty claims must be directed to TREADIVO in the first instance. We will assess, coordinate with the manufacturer where appropriate, and provide the lawful remedy. Do not drive on a tyre you suspect is unsafe. Returns and refunds are governed by our Refund, Returns, Cancellation & Rescheduling Policy, which forms part of these Terms.

10.Intellectual property

All content, branding, software, images, data and materials on TREADIVO are owned or licensed by Tyreo Pty Ltd and protected by intellectual property laws. You may not reproduce, modify, distribute or create derivative works without our written consent. Product images supplied by brands or wholesalers remain the property of their respective owners and are used for catalogue purposes.

11.Privacy and data

We collect, hold, use and disclose personal information as described in our Privacy Policy. By using TREADIVO you consent to that handling. We use third-party services such as Stripe for payments, Outlook/calendar integrations for booking notifications, and analytics providers. Their privacy practices are governed by their own policies.

12.Changes, suspension and termination

We may update these Terms, the catalogue, pricing, services or policies from time to time. Material changes will be published with a revised effective date. An accepted Order is supplied on the Terms in effect when the Order was accepted. We may suspend or restrict access to TREADIVO for maintenance, security, legal reasons or operational needs. We may terminate a User's access for repeated or serious breach of these Terms.

13.Governing law and disputes

These Terms are governed by the laws of the State of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any competent Australian court. If a dispute arises, the parties must first try to resolve it in good faith through TREADIVO customer service. If unresolved, either party may pursue its legal remedies. Mandatory consumer dispute-resolution rights under the ACL are not affected.
